There is a question on I-130, #13.

I am submitting the I-130 this Aug 2009 and would like to answer the question accurately.

Question 13: Has your relative ever been in the US?

The dilemna is she is currently here in the US since Nov 2007 and has been in Guam in 2005.

1. So does the question ask if she has been in the US prior to her current stay???

Or does it asks ANY visit to US including the current stay??? :unsure:

2. Does "US" refer to the mainland or does it includes territories like Guam??? :unsure:

3. So is it a YES? :unsure:

I would say that you have given the answer already. Being untruthful in this process is not advisable. Nor is trying to rest a version of the truth on a technicality.

Answer is YES.

I am not sure if Guam would count. My thought would be it is better to list it and the information not be needed.

She is here in the U.S now as you stated right? Simply put you answer "Yes" and remove any doubt of weather you answered the question correctly.
