Hello, my girlfriend and I are considering a K1 visa /she is colombian/ and if she were to come to the United States and /after 90 days/ we decided to get married when could she go back and visit with her family in Colombia. Thanks for your help, /gracias/

You both would have to get marry, then apply for Adj of Status and include the form that is called Advance Parole, it takes around 3-6 months to receive it back, then she would be able to travel without not problem.

I hope if she arrives on a K-1 you decide to get married BEFORE the 90 days or you cause yourself a few more problems

A k-1 can depart anytime, but if they want to return to the USA then then need to wait for Advance parole (60-90 days processing) or greencard. Neither of which can be applied for until after the marriage event has happend

Good luck with the K1, Andrew, for you and your lady! We are going through it too, and have been together for the past 3 years, with a 21-month old little boy, and our baby girl who is due in 5 weeks from today. We have our appointment at the Embassy in Bogotá on August 25th. I hope to God that my future husband can be here before our little girl makes her appearance into the world. Once she comes to the US ona K-1 visa, you have 90 days in which to get married. As soon as you marry, apply for an adjustment of status, which takes approximately another 3-6 months. After that, then she can travel to Colombia....Once again, good luck!!!

A. Its called a fiance(e) visa because it is used for those that are ENGAGED, NOT wanting to visit the US and see if they want to get married.

B. You have 90 to be married not wait and decide.

C. If you did use the fiance visa and got married in the 90 day time frame, then you would need to file for AOS and it takes 60-90 days after they receive your application.
