hi everybody,

I'm in the middle of fiancee visa application. And I'm going to postphone it. But I want to visit my fiance in the US in two months. So I need to apply for tourist visa. But when I fill out the DS-156 form, there is a question I need to answer:" Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?" What should I put down, yes or no? If yes, will my tourist visa be refused?

K1 is a non-immigrant visa.

i would suggest that you keep the K-1 in the process and don't postpone it, you getting a tourist VISA to the US is pretty difficult, you will need to prove to the US consulate and to the boarder agent that you will return home, some example of proof is letter from employment, utility bills, some sort of debt that you owe to China that requires you to return to China in a short period of time.. besides, the K-1 petition is already on your file, so even if you cancel it now, it will be there, and even if you made your way across the ocean to the US, the boarder patrol agent already see your your attempt intent to move to the US, so he might not even let you through and he will put you on the next flight back to China... this is my 2cents..

Thanks for your 2 cents. No matter I will go visit my fiance or not, I will still postphone my K-1 application due to some upexpected reasons. That's why we want to meet as I won't move to US so soon. I have been to US 3 times before for biz trip, so I guess I should not be suspected not to return back to China. But you said the boarder patrol agent might put me on the next flight back to China as K-1 petition is already on my file really scares me... :-(

it's scary but its a risk you have to take if you want to come and visit.. people have been turned away before, so just prepare yourself to explain to the Customs and boarder patrol agent, he makes the decision weather to let you enter or next flight home... if you can get another business VISA then you should have no problem, but a visitor VISA might be difficult..
