AOS - Case re-opened

Hi all,

Some of you may remember that the kids and I had our request to adjust status denied and our case closed due to a stuff up by the San Francisco District Office. To cut a long story short, we filed a motion to have the case re-opened and they have accepted/approved that motion. Now we are just waiting for a letter requesting another final interivew.

In the meantime, I am wondering if my EAD, which was cancelled when they denied our case, will have been re-instated/re-validated or will I have to apply for it again? I'd appreciate advice from anyone that has been through a similar problem.

I think is hard to tell so if I was u, I'd get an info appoiment to talk with an immigration officer.

I'd consider your EAD re-validated until someone tells you otherwise. Your AOS case is pending again, so your EAD, "attached" to that AOS, is valid. This is my opinion, you could double check by making an infopass appointment.

My AOS was denied too and I had same question for the immigration officer on my infopass appointment and also I asked an immigration lawyer about this later. They both had the same answer, that EAD was revoked/cancelled and that's it. If you want a new one you will have to apply for a new EAD after the motion to reopen was granted, you can't use the revoked card.
