Hi...I am a Canadian citizen wanting to visit my boyfriend in the USA. Last time I went, my travel dates were from July 6th to July 27th of 2009./ The CBP officer gave me a B2 visa for the return date of July 30th which is such a short time. I think he might have thought I was going on intent to immigrate but that is not the case. My question is am I basically black listed and now every time i go to cross the border will they check and see that I am traveling again and could they deny me entry? Please help

No, you aren't black listed, but you may come under scrutiny when you cross again to ensure you abided by the terms of your previous entry. I suggest going with an armament of ties to Canada to show that you intend to return.

But yes, they could deny you entry. I am hearing more and more Canadians getting denied entry these days. Go with ties to Canada and tell the truth and you'll be fine.

Hi again,

Thank you for responding. Like I said I have no intentions of marriage at this point but I am sure if he asks I will say yes to marriage. My plan is to return November 10th and then register for school although I have no proof of this as I will only be registration when I return to Canada. I do live on my own so maybe I can show them a lease and some bank statements if asked. Is that enough proof?

Lease and bank statements are good, so are things like utility bills that you are paying, or even a doctor's appointment card (that worked for me once). I also used a wedding invitation to show I intended to return to Canada.

Thank you for responding again. I have yet another question and am hoping you can help. I contacted border patrol and they advised me that my B2 visa is valid for 10 years but I have to get another I-94 form. Is this necessary for me to get? Should I ask for it or should I wait? Since my travel back home is Nov 10 ( I might want to extend this date) Can I ask them to give me a certain amount of time if i choose to stay a little bit longer? I am so confused and any help would be appreciated. Also what if I do get married while on this I-94 form which I am sure will only be valid again for a certain amount of time, can I stay in the USA and apply for AOS? How does that process work? Agin thank you for responding, I truly appreciate it!

That's odd, did you tell the CBP that you were Canadian when you called? Generally B-2 visas are given to tourists to visit, Canadians work a little differently. Canadians are on a type of visa waiver, B-2 are typically given to Canadians when they are granted a limited stay, like you were. If I were you I would cross for your visit and tell them the date you are intending to stay. If asked, let them know you were granted a B-2 visa in July. They'll know you already had a B-2 visa granted anyway.

DO NOT plan on getting married on your tourist visa. Since you are asking about the procedures I assume this thought has crossed your mind. You risk a ban from the US (included with your deportation) if you misuse a tourist visa for immigration procedures.

I am not planning on getting married but just wanted to know if I had any options if we decided on the spur of the moment to get married. We have never spoken about this but I would love to eventually marry him and be with him so I was just inquiring about the procedures before hand.

I don't know if the rules for Canadians are different... but...

You CAN actually get married on a tourist visa..... as long as you leave the country before your 1-94 expires, and don't try to stay.

If I'm wrong I'm sure somebody can correct me if I'm wrong.

You are correct, the OP is not talking about getting married and leaving, she was talking about adjusting status from a tourist visa after marriage.

When you said you 'contacted border patrol' when did you do that? How did you do it - call?

I called border patrol yesterday. I just want to know will I be issued another I-94 form for traveling again? Also If I can marry while on a tourist visa, is there a way to stay in the US and apply for AOS cause I mean this is not our intention but I dont know anything could happen and I just want to make sure what I need to do.

So back to my original question, when you contacted the CBP did you tell them you were Canadian?

There is no way to tell if you will be issued another I-94 until you cross again since it is up to the CBP if they issue one, they may limit your stay again based on your previous limited stay or they may not - no one can answer that question since it is up to the discretion of the CBP you get when you cross.

If you marry 'spur of the moment' then yes you can AOS - it will be up to you to prove that this was not your intention when you crossed.

Hi,

Yes I did tell them that I was Canadian. Thank you for all of your responses. I truly appreciate your help. I hope I do not get another I-94 form. I felt like I was breaking the law at that point. Not a good feeling.
