In a disorderly way in public its not excusable by law. The screaming fire is another example. Slander is another example.

The screaming fire example falls under the category of "clear and present danger".

I'm not aware of any First Amendment restrictions for expressing an opinion in a "disorderly way in public".

Slander is something entirely different and "I hate cops" is not it.

True but this was not my point my point was that free speech has its limitatations too. I was responding to MC saying -

Yes, even the First Amendment has its limits, but not to the extent you imagine. One of the tests

the Supreme Court uses in such incidents is that of "clear and present danger." Is there, from

someone's speech, a clear and present danger that there could be violence or tragedy?

If there is, then that can be restricted; otherwise - no.

Defamation is another example, but the Supreme Court ruled that opinions could not be

considered defamatory (see Gertz v. Robert Welch, Inc.).

I do understand the first amendment. I was responding to what MC had said. My point was that we are not free to say whatever we want whenever we want, there are limitations. I gave some examples and slander happened to be one of them.

By law in public viewing or public place a officer can arrest a person disturbing the public through verbal means. This usual requires the person yelling foul things at people in a public place, Disorderly conduct.

Let's say a person approaches a police officer - calmly and quietly, in a non-threatening manner -

and tells him that he hates cops?

Do you think he should be arrested?

If the cop was being verbally taunted in a non threatening manner but in a very disrespectful way I would be more than happy to give the officer the power to issue a citation.

It's funny to consider the liberal mentality and how it works.

Take note: the more liberal a person is the more likely he will resent cops.

They reject the idea that an officer in the Justice system be treated with respect (cops) but they don't bat an eye at the way a judge will cite you on the spot if you speak out of place in their court room.

I have seen it happen twice.

Why don't the Libs spend their off time in court rooms pressing this freedom of speech point rather than badgering a cop on the street?

There is an answer... anyone want to guess?

Can anyone deny liberals have waged such war against "law and order" on the street that it's no wonder we have so few good people signing up for the force.... and then they complain even more.

NOw I'm not suggesting cops should be above the law or that John Q citizen need bow before them by any means but they represent Law and Order and should not be subject to public taunting.

Truly Liberalism is "national suicide".

The area which gives me the biggest belly-laugh is how you cop-haters can't stand the authority a cop has over you... yet you embrace things like "Obamas Health Control plan" which will have much greater control and no means of escape for anyone ... by the time the flower blooms.

It's just my opinion but I think the cop should punch you right in the mouth if you taunt him with insults.

Who are you to hide behind the constraints of his uniform if you don't even respect it?

I wouldn't do it, but I think it falls well within the range of free-speech. Certainly nothing that should merit arrest and/or assault.

But I'll remember this post - the next time you get all offended about infringements of free speech.
