my fiance got packet 3 about 5 days after the date it was sent out and we are still working on it...i am wondering what is the time limit in which to complete and return the packet to the embassy?

But in theory, you have 1 year, I believe.

If US Embassy doesn't receive anything from beneficiary/petitioner for 12 months, they will close the case with administrative denial.

But in reality, you have to follow up sooner because some of documents you sent may be expired if you delay a lot.

Usually it won't take that long to prepare for listed items. No more than 2~3 months. :whistle:

thanks thats a relief cause i was hearing they only giv u 2 weeks to return packet 3. good to know thats not the case :)

Year? Go by the date on your NOA 2. Usually less than a year.

When that expires, your petition expires. That is why you have to contact them to extend the NOA 2, if needed. (sometimes the embassy will extend automatically, but ...)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

My I-797 expires on August 02,2009.I am under AP , I am wondering if i will have to apply to extend it or is it automatically considered extended?

Year? Go by the date on your NOA 2. Usually less than a year.

When that expires, your petition expires. That is why you have to contact them to extend the NOA 2, if needed. (sometimes the embassy will extend automatically, but ...)

I would double check - since the embassy is "doing" the AP, they should extend it automatically - but better safe then sorry!
