Hi!

I am new here... I have heard a lot of good things about this site.

And now, i would like to ask for your advices regarding my question...

My fiance sent all our papers to his lawyer last June, and lawyer told him that it was already sent to the USCIS, just wait for the acknowledgement receipt from 10-15 days,, we waited but fiance dont get any aknwledgement that USCIS received it... then lawyer told him that papers went back becoz he did not give payment for the application... fiance paid in check last week,, lawyer told to wait... until now no confirmation yet that the USCIS received our documents.

i am just confused coz most of the timeline i see from other friends already got NOA1 few days after the USCIS received their packet and afer check was encashed.. Is there a problem here? Coz time is running out, but then i think lawyer would like to play dumb with us...

Well - if your lawyer forgot to send the initial payment with your petition, I would not be surprised if there wasn't something else wrong with it...

I would be talking to the lawyer and seeing what he says.

BTW - you paid by check? did it get cashed yet. Since you sent it in last week, it should be coming along any day now.

(that is - if your lawyer sent it on time)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Good thing you have a lawyer. Time is not running out, you have plenty of time. You will need lots of time as your lawyer is not doing things correctly.

It is not unusual for the receipt to take more than a month to arrive, it means nothing. The processing begins when they have your case. If the check is cashed, they have your case, you do not need the lawyer or a letter to tell you this.
