864 and 134 New Delhi

Hi,

I mentioned this earlier and was curious what others did:I live with my brother who files taxes independently (and makes more money!) but we live in the same house (after all, we are brothers!). However, New Delhi requires he be claimed a dependent (fortunately, I make enough money to support my spouse who I am filing for, and my brother). Did anyone else have similar or different situation? And which line item would I put my brother?

It is so odd because the 864 asks for Tax Returns and in that I have no dependents. Is this not a contradiction between IRS/USCIS and New Delhi Embassy?

I just want to do the right thing.
