hello vjers ,

Is form 1040 , will be enough as proof of financial capacity by petitioner or does petitioner need to have a copy of W2 or 1099 ? I am asking bcoz hubby doesnt have copies of form W2 nor 1099 , he only have form 1040 , as he send these forms to his accountant ,who prepares his income tax return. So, I told him to call IRS and ask for transcript of federal tax returns of the past 3 years ; I have asked my hubby to gather tax returns now before letter from NVC arrives ;

Tax return (form 1040) by itself is not enough - it must be accompanied by any/all supporting documents (such as W-2, 1099's etc). If a sponsor does not have these supporting documents then I would suggest ordering (free) IRS Tax Transcripts which contain all the necessary 'supporting document's' information.

Do not submit tax returns with no supporting documents - it is certain RFE/delay.

If he gets the tax transcripts for the last three years you will be fine. They probably won't even look at 2006 and 2007 but no need to take a chance. Don't forget supporting docs like letter from employer and from the bank. Good luck. Mike

when i had my interview we only had 2 yrs of 1040. my husband is self-employed so i guess he doesnt need the W-2... plus the I134 and letter from the bank. thats our supporting docs (financial side)

What IS required is any and all supporting documents; be that W-2's or not - whatever supporting documents the IRS required to file the return is what is required to accompany the ITR/1040. (You may not realize more documents were submitted but there had to have been; 1099's, schedules, etc.) :thumbs:

i do know what docs we submitted and perhaps we might have needed the 1099 back then, but as ive said we only presented the 1040 self employment tax (as what the form said) for his 2 businesses back then (just the first 2 pages of his ITR) 2004 and 2005... you might think i must have forgotten it already coz it was more than 2 yrs ago, but i still have the copy of that petition and i did check it 5 mins ago just to make sure... we could've been mess up during the interview for lacking of docs presented but i guess we we're lucky coz we passed the interview. :blush:

definitely no W2s ,I asked him , he said he gets form1099 , for independent contractor ; well I think it is better that he gathers them now , well , thank you so much for all the infos guys . wag kayong magsasawa sa mga tanong ko, and definitely this is not the last . :)

Yeah. If your husband is self-employed, he doesn't need the form W2. Just show them the form 1040.
