Hello again fellow vjers,

I really need your help as am confused and don't know what to do.About a month ago my hubby had a bad accident and lost his job as he was fired by the company he was working after that incident.

We already filed the I-130 for my 2 kids and we are still waiting for our NOA2.Am afraid and don't know what should we do now?

We don't know when the petition will be approved.,my questions are: By the time we get an approval notice from the USCIS which we don't know when??

1- Is there anyway we can delay the AOS and Choice of agent thing? We have enough money for the NVC but our problem is the papers we need to submit for our proof of income as we are still both looking for a job until now(Hubby was making more than 50k a year for the last 3 yrs of his ITR.

2.We already paid the application fee for 2 kids ($710.00) and we do'nt wanna pay the other $870.00 yet(NVC $400 each + the $70AOS fee) if only they will deny our case for not having any income as of now as we will be wasting money doing that.

3. Once we get the NOA2 or approval notice should we need to send the affidavit of support right away? That worries me coz what if hubby still don't have a job by that time?

4.How can i send the affidavit of support when he is not working as of this time? We can not find a co sponsor .

5. When we get the approval letter should we just pay the $870.00 (AOS+ Biometrics)? What if they will deny it after paying coz we dont have proof of income?

Pleaseeeee am really so worried i dont know what to do??Dont wanna waste another $870.00 aside from the $710.00 we already spent?Any suggestions would really be a big help. Thank you so much.

1. THE AFFIDAVIT OF SUPPORT IS A MUST. ESPECIALLY IF HE IS EXPECTED TO SUPPORT 3 PEOPLE (YOU AND YOUR 2 CHILDREN)

2. IF HE HAS NO JOB NOW, HE MUST FIND A CO-SPONSOR WHO HAS INCOME ENOUGH TO SUPPORT YOU AND YOUR CHILDREN.

3. ALTHOUGH YOUR NOA2 IS STILL YET ON THE WAY, MOSTLY WITHIN 3 MONTHS SINCE FILING IT ARRIVES. THE APPROVAL DOES NOT GUARANTEE YOUR VISA GIVEN BY THE CONSUL IF YOUR HUSBAND CAN NOT SHOW AN EVIDENCE OF BEING ABLE TO SUPPORT YOU AND YOUR CHILDREN FINANCIALLY.

HENCE, THE AOS QUESTION YOU HAVE IS TOO FAR FETCHED AT THIS POINT YET.

Thank you for your reply. I understand that. My only concern is , is it a good idea to go ahead and pay the $870.00 to the NVC as soon as we get the NOA2? or we will not pay it till hubby gets back to work? The reason am asking this is..we do not want to waste another $870.00 if its for sure they will deny it because of the affidavit of support.Hubby needs to get a job that makes more than what he was making b4 since he will have 3 of our kids and me as his dependent.

After your approval your case can remain at NVC for one year before they return it back to USCIS as abandoned. You can wait on paying the fees to the NVC until your husband or you finds a job. If you have enough savings to cover the affadavits, you should be OK, I think your savings have to amount 7 times the poverty guidelines. Also if your husband is the biological father AND is a US citizen then the children can be exempt from AOS, but only if he is the biological father. Once one of you finds a job, then you just need a job letter and your previous 3 years tax return.
