Hello,

actually my friend is citizen and she filled for her parents i-130 they are in U.S.A. on B1 or B2 visa so can they stay in U.S.A.? or they haev to go back. also her mother's visa is expiring in 2 months and she just filled last week so what is the time period for USCIS to reply or get approve on the i-130

if anybody know the answer please help us.

As soon as they get the NOA1 for the I-130 they need to file for AOS, this should have been done together as per the instructions on USCIS website but all is not lost.

They do not need to wait for the I-130 to be approved they just need to include the receipt from the I-130 along with the application for AOS.

Once that is file they can remain in the US while the case is pending.
