Hi Guys.

I was wondering if you could give me some feedback/answer a question.

I assembled our AOS packet today, waiting for one more document - an IRS transcript for 2008 (my copy was kept at the embassy during my then fiancee's interview). I have the following:

1) Forms: I 485, I 765, G 325A, I 864 + 2 Photographs

2) Supporting Docs:

a) copy of I-94

B) copy of K 1 in her passport

c) copy of my passport ID page, her passport ID page

d) copy of my birth certificate, her birth certificate + certified translation

e) 2006, 2007 Copy of Tax Refunds, bank statement, employment verification - IN SUPPORT OF I 864

f) copy of my naturalization certificate (I am not a native born USC)

g) copy of approval notice for I 129, copy of the marriage certificate (certified)

h) copy of the vaccination documentation worksheet (got that from her medical before the K1 interview)

3) Filing fee of $1,010

My fiancee (now wife) entered the US on May 3rd. We got married 2 weeks after that. We are now ready to file the packet. Is this enough time for us to send the packet and get an NOA?? Am I just freaking out for no good reason, thinking that we might not get NOA 1 before I-94 expires?

Please give your feedback, hopefully you'll tell me that I'm just panicking ;-)

You are freaking out for no reason, as long as the I-485 is fled before or soon after I-94 expiration you will be fine.

Your list looks OK, however each application needs it's own set or passport photos, so 6 pasport photos, I-131 and I-485 each needs it's own copy of I-94 card. Treat each application as a separate application, so DO NOT share things like passport pics and copies of I-94 cards.

Laughing yes, I think we all freak out a little ... but no need RFE ae painless but time consuming.

I do think you need 2 and 2 photos. We sent 6 photo because we did the AP for I-131 advance Parol.

If you do only the forms you have get another two Photos and have 2 bags 2 in each.

I think I would do the I-131 and two more photos it's part of the cost of the $1010.00 and if you two want to leave the country it make it easier since you are authorized then.

Hello,

I just wanted to contribut what most ppl includes in their AOS application. Yours look fine. Here's a checklist I and most of VJ members followed to apply for AOS.

Credit Goes to NichNick (VJ Member)

-485 (Adjustment of Status)

Photographs (2) of immigrant (passport type)

Photocopy of birth certificate of immigrant with translaton

Photocopy of passport biographical page and K1 visa page

Form G-325A Biographic Information Sheet (immigrant)

Form I-864 Affidavit of Support (by USC) with photocopies of supporting documents: This varies by each applicant so here's generic suggestions

---Employment letter

---3 tax returns including copies of W2s (Photocopy)

---six recent pay stubs (Photocopy)

(If needed)Form I-864 Affidavit of Support (by Co-sponsor) with photocopies of supporting documents:

---Proof of co-sponsors citizenship/status, ie US birth ceritificate, bio page of passport, naturalization papers, or LPR status

---Employment letter

---3 tax returns including copies of W2s (Photocopy)

---six recent pay stubs (Photocopy)

Photocopy of I-797 Notice of Action, I-129 Petition Approval Notice from USCIS (That's your NOA2)

Certified copy of Marriage Certificate

Photocopy of Form I-94 Arrival/Departure record (card from the plane, may be stapled in passport)

Form I-693 with the immunization section filled out by a US Civil Surgeon, signed and sealed by him. Read the instructions for the form.

or DS-3025 from UK medical if all shots were completed at Knightsbridge if you want to take that chance

I-765 (Employment Authorization)

Photographs (2) of immigrant (passport type)

Photocopy of passport biographical page and K1 visa page

Photocopy of Form I-94 Arrival/Departure record

I-131 (Advance Parole travel document)

Photographs (2) of immigrant (passport type)

Statement of circumstances that warrant issuance of advance parole. (check the bold statement at the end of this reply). This is what you would have to type/copy/paste. But also mentioned any future travel dates if you could have. But normally if you dont have any specific dates of travel, copy the same format and take a print out.

Photocopy of passport biographical page and K1 visa page

Photocopy of Form I-94 Arrival/Departure record

And a check for $1010 made out to the Department of Homeland Security

That's 3 separate applications with supporting evidence all mailed together in one envelope with one check. They will get processed in different places, so that's why the duplication of evidence. You don't have to do all three, but the second two are free if sent with the AOS and will get you authorized to work or travel sooner than waiting for the green card to arrive in most cases. Green card could take 6 months. Work and travel 60-90 days.

Do not work until the I-765 is approved and you have the EAD card

Do not leave the US until the I-131 is approved (K1s) and you get the travel documents or you will not be allowed back in. Once you have a green card, then no problem.

Statement of circumstances that warrant issuance of advance parole.

I wish to apply for advance parole and obtain the necessary permission to travel to my home country prior to receipt of permanent residency status in the event of emergency or family illness. I do not have any specific plans to travel at this time.

When your packet is ready to shoot, then you would have to find the correct address on which you need to send the packet. It varies according to the location you are living at. Go to the website mentioned below to find out the USCIS office, that deals your area.

If you ever have to move to the new address, after filling of the AOS application, you need to inform USCIS by submitting AR-11 Form. You can do that online on this website

US citizen doesn't have to fill out AR-11 form but the other one USCIS has on its website.
