About My Case:

In 2001, I filed with my parents to adjust my permanent resident status in the US.

Apparently (I just found out, you'll understand why in a bit), I was granted permanent resident status in Oct. 2003

Somewhere during this waiting period, our lawyer at the time was indicted for immigration fraud, in which neither my parents, nor myself had any participation or awareness of.

However, even after finding this out, we all continued to receive employment authorization cards.

What we did know is that all of the lawyer's material was confiscated and he was set on trial; he was found guilty, however, no final say was given regarding the matter and until now nothing has turned up about it.

In Nov, 2007 I got married to my wife who is a US born citizen. Her and I applied with USCIS and she petitioned for me. With our new lawyer, everything went according to plan and we were told by him that my first case would have no bearing on my new case with my wife. IN a timely fashion, we received a letter for interview, which was successful as well. After that we were told that the average wait is approx 6 months to receive a conditional green card. However, today, I received a letter that my application had been denied not on the basis that my new application was incomplete or lacking in any way, but that I had been granted permanent resident status already in October 2003. I have no record of this status except for the letter that I just received today. Though I have been legally able to work by way of EACs that are renewed every year, i still havent received a card. Even after my filing status changed from my parents to my spouse, which subsequently changed the clause under which I filed, I still was able to receive an EAC without any issues.

I dont know what I should do because I have no proof of my permanent residency. I would like to contact the local USCIS office and find out if I can get a new card sent to me by filing an I90, but am not so sure that it was ever sent to me in the first place. I am aware separate USCIS offices deal with separate matters. Please advise me on what the best solution to this situation would be. I did not file with my spouse because I wanted to just obtain a green card; that is, I got married to her for all the right reasons as we want to be able to stay together here in the US and continue with our future.

Just fill out the application to have a new card sent to you, and after you receive it, you can think about applying for citizenship. You should be eligible by now.

Submit the I90, there should be an option on the form where you can state you never received it. It usually takes 3-4 months to get the new card.
