Hello every. This is the first time I post here.

I plan on marrying my boy friend that came with a work visa. I have a few problems or questions.

His work visa was issued for Arkansa but he didn't stay over there he came to California with me instead. He did report to Arkansa first before coming to California.

Here's one question:

If I marry him is that going to be a problem that his visa was issued for another state?

His visa will expire the 1st of August.

My other question is:

If we get married before his visa expires and we don't have the money to do the adjust of status before his visa expires, will he be illegal?

Visa's aren't issued by individual states - it is a federal 'thing' - exactly which Work-related visa did he enter on?

Expired visa - overstay clock begins to tick the day after the visa expires - with no pending application with USCIS, his status is 'out-of-status' (some call this illegal since he is in the country with no legal status).

Hmmm he won't be here illegally but he will be out of status, my recommendation will be to get married and submit the paperwork before his visa expires, either way since he entered with a valid work visa, the majority of times overstaying and being out of status, even working illegally in this country, is forgiven after marrying a US citizen as long as he didn't entered the country illegally.
