we have alot of evidence for removing our conditions with our i-751- lease-joint health and auto insurance-banking documents etc etc but we didnt have to file taxes we had no income in 2008 i recived a servence package in late 2007 which were still living on and my wife is a full time student should i just send in what i have or should i include a letter explaining our story are tax returns mandatory

don't need a w-2,... there are all sorts of different types of income.... interest, dividends, etc... if you don't have any income for that line put in zero (0)

I agree. You should have it done instead of receiving RFE if you send without one.

04/05/2010: Sent package to Dallas, TX lockbox via priority mail with delivery confirmation

04/07/2010: Package delivered in Dallas, TX

04/14/2010: Notice Date

04/19/2010: Received NOA in the mail

04/20/2010: RFE sent (Should it be the biometric letter?)

04/24/2010: Biometrics letter received (it is the RFE) scheduled for 05/06/2010

04/29/2010: Biometrics done (early walk-in)

05/19/2010: Received email advising that case has been transfered for standard interview at local office

05/21/2010: Interview letter received with notice date 05/17/2010

06/22/2010: Interview - passed

09/14/2010: Oath Ceremony at Boston, MA - Officially became US citizen

Hmm, I did not send in my tax return with my package. I filed as married filing seperately (or whatever it is called). I added in a note, explaining how and why I filed that way. I also said that if they need a tax return, they can ask me and I'll send it (maybe I should have sent it anyway, but it didn't seem important). I believe that a tax return is not mandatory at this stage. I would just include a letter explaining that you had no income and did not file and send in the tax return from the year before.

12/18/2006--------Touched I-130/I-485

01/20/2007--------Biometrics

05/10/2007 -- Interview, Approved!

05/22/2007 GREEN CARD arrives!!!

02/2009 - File to lift conditions

I-765

12/14/2006--- Mailed EAD App.

01/20/2007--- Biometrics

02/09/2005-------Sent in request to Congressional office for assistance with expediting EAD.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

Hi Emmet8,

Likewise, I was in a similar situation when I filed my I-751 too. I filed with 100+ pages of joint evidence, but did not include any (zero, ziltch, nada, none, no) tax returns/transcripts, as legally, my husband and I did not need to file taxes. So to explain our tax-less situation, we both just included additional evidence that stated such, along with a letter explaining our situation.

Needless to say, we got approved without any tax returns/transcripts, and with no rfes or interviews about that.

For your situation, you should enclose evidence of your wife's full-time student status (report cards, letter from the school, tuition bills, etc.), evidence of your servence package in 2007, explaination as to why you have no income in 2008, and any other information and/or evidence regarding your lack of tax returns/transcripts.

No need to deal with the IRS in your situation...forget about filing additional taxes when you legally don't need to...;)
