Do I need to file an extension for my wife?

Hi,

My girlfriend came here to the U.S. in January of this year to visit me. She traveled on a tourist visa. We decided we didn't want to continue flying back and forth visiting each other in Mexico City and St. Louis, and so we got married in here in St. Louis in April.

My wife's Visitor's Visa expires the beginning of July. A couple of months ago, I filed everything with immigration, i.e., petition for alien relative, affidavit of support, biographical data, etc. I checked my online banking account this past weekend, and saw that the check was cashed last week.

Does the fact that the government cashed the check mean that my wife can stay here in the U.S. beyond the expiration of her visa? Or do I need to file for an extension on her visa?

If I need to file for an extension, please tell me which form I must file.

Your wife stopped being a tourist when she sent in the application to become a permanent resident...so she is not eligible to extend her tourist visa. Your wife can stay in the US past the expiration of her visa, and she is a pending immigrant now. She should just not leave the country while this paperwork is pending.

Indeed, I second that advice.

DO NOT let her leave the country before having either her green card or Advance parole papers in hand.

05/01/08 Green Card in mailbox!!

06/05/10 Real GREEN Card RECEIVED!

01/17/13 Sent application for US Citizenship!!!

01/19/13 Arrived to Arizona Lockbox

01/24/13 Notice of Action

01/25/13 Check cashed

01/28/13 NOA received by mail and biometrics letter mailed as per uscis.gov

02/14/13 Biometrics appointment

03/18/13 In-line for inteview
