Will it be okay to submit AOS application 22 days after the expiration of my I-94?

I need advices... :crying:

We just goy married last May 16th and my I-94 got expired last May 28. Are we gonna have problems in applying for AOS since my I-94 is expired already?

We're planning to submit the AOS application on the 19th of May.

And as of this moment, I am not yet done in assembling the AOS/EAD/AP application.

Sooner the better - yes it's fine - not like you have a choice right?

I'd bet more people file after their I-94 expires than do before it expired (unscientific but just a gut feel) and most are successful. I wouldn't worry about it. :thumbs:

We filed about month after the I-94 expired & had no issues at all (got our biometrics appointment with no questions asked).

08.01.2011 - I-751 SENT

08.05.2011 - Check cashed

08.08.2011- NOA Received

08.19.2011 - Biometrics Letter Received

09.12.2011 - Biometrics Appointment

01.27.2012 - Card production ordered

02.01.2012 - 10 year GC Received

07.25.2021 - N400 filed online

08.09.2021- Biometrics re-use notice

04.18.2022- Interview done at Minneapolis USCIS Local Office   ✔️ Received N-652 "Congratulations your application has been recommended for approval" during the interview.

05.19.2022- Oath Ceremony in MN

They forgive overstays by immediate family members. That's why there is no specific filing date. Still get it in as soon as you can so the non-USC can work/travel/get government ID etc sooner. Plus there have been a few people on here in the last few months having run ins with immigration for not having filed yet (and being over the I-94). Obviously most people have no probs, but better to be safe than sorry.

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08
