After reading about an RFE post here, I read our notice again and I'm confuse now.

I got my RFE and my son's RFE and here is what's in there: (notice the lines in red)

MY RFE

Request for Additional Evidence (I-485)

This office is unable to complete the processing of your Application to Register Permanent Residence or Adjust Status, (Form I-485) without additional information. Please submit the information requested below.

I-693 Report of Medical Examination and Vaccination Record

The record shows that over 12 months of time has transpired since you were medically examined in conjunction with you K-1 entry.

Form I-693: Please submit a properly completed and signed Form I-693, Report of Medical Examination and Vaccination Record. The medical examination must be conducted by a physician who is on the list of Civil Surgeon approved by USCIS.

SON'S RFE

Request for Additional Evidence (I-485)

This office is unable to complete the processing of your Application to Register Permanent Residence or Adjust Status, (Form I-485) without additional information. Please submit the information requested below.

I-693 Report of Medical Examination and Vaccination Record

TUBERCULIN (TB) SKIN TEST: Current regulations now require that the tuberculin skin test and/or chest X-ray be completed by all applicants 2 years of age and older. Your Form I-693 reflects that you have not had a tuberculin skin test or chest X-ray performed. A chest X-ray is required only when the reaction to the skin test is 5mm or more ...(so on)

Me and my son had the same medical exam date, 4/23/08, and I understand that we submitted our AOS application close to the expiration of our medical exam. What confuses me is whether I should get a full medical exam for my son or just the TST?

If your visa medical was less than a year ago, then just the test and vaccinations section should be needed.

What was the date of your medical? They think it's been longer than a year so aren't accepting it. If your NOA date was less than a year from the medical, then you might try to speak to an officer or make an infopass appointment and insist you applied before a year had passed and their slowness to review it should not penalize you to have to go through another exam. It's in the rules that way.

About your 2 year old son. Did he have a chest x-ray at his medical or any test to rule out TB? Perhaps he was too young. If he didn't, then he should have a TB skin test to send to USCIS before they can approve him.

Our medical exam was on 4/23/08 and yes we received NOA prior to expiration of our medical exam but I called USCIS and spoke to an IO, she said that because I have been in the US for a few months being out of status, they'd require to have medical exam which I understand.

My son was less than 2 years old when he got his medical exam in the Philippines, so he didn't get TST that time. So, should I just get the TST for my son instead of the full medical exam? It says in the notice that they want I-693 Report of Medical Examination and Vaccination Record (same as mine), then below that is the TST.

I believe that is a general heading, like a title--Medical Exam. Another RFE might have had the title Affidavit of Support.

Then underneath your title, they give you the specific part of the medical exam that is missing or in your case expired. I think your son only needs a record of being free of TB, which can be shown with a TB skin test.

That's what i understand too but I just wanna make sure. Tomorrow we'll go to the Civil Surgeon and get the test and exam done.

I was just confused cos we both have the same heading in the letter and we both have the same medical exam date, but the description in the RFE is different which confuses me.

But thanks for y'all response. I truly appreciate it.

I think that's what they are asking for, but it doesn't mean that they won't come back later and decide your son's medical is out of date too. But for now the TB test will answer the RFE. They probably don't really need to check for HIV and venereal disease in a child, so are mainly concerned with TB and his immunizations.
