Hello Fellow VJ'ers,

just wanted to ask about the I-94 from the POE..i know about it coz I had mine and the officer attached my I-94 to my passport.

My friend arrived here in the US on April 18,2009 and got married May 27,2009...she called me regarding the I-94..she said she don't have I-94 ,the officer on her POE didnt attach the I-94 on her passport, now she's worried about it bcoz we know that we need that for AOS.

She also said that she filled up the I-94 (which is white form) on the plane then when the plane landed on her POE..the officer said she dont need the I-94 white form that she filled up...officer gave her a blue form and told her to filled it up and so she did..then she had her fingerprints, picture and told her she's done and she can go to her next connecting flight.

I gave her the USCIS number and told her to call and ask about it.

The officer didnt attach her I-94 on her passport.Anyone experience this?

Hoping for speedy answers.Thanks.

I arrived POE Detroit February 24 2009 and immigration stapled my I-94 to a page in my pasport. Best thing to do and it can not get lost.

What type of visa did your friend arrive on?

I've had I-94 not attached to passport lotsa times (but that due to having a work visa renewed from within US) and had no problems re-entering with such.

it is very unusual that she was told she didn't need the i94, because that's what's attached to everyone's passport if they are on a K-visa, and when she applies for her AOS that unexpired i94 is the no.1 document that needs to be attached to the AOS application....so if she really was given another form, what's the label on that form? what did it say, it should give her a clue as to what to do.

otherwise, yes have her call uscis right away

I found this:

http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

But I do not want to pay $320 for replacement of a form that some idiot in immigration neglected to give her.

Wait, nevermind, it says there is no fee if immigration screwed up:

"Special Instructions:

Note on Filing Fees for I-102:

You do not need to pay a fee to request to correct your Form I-94, I-95 or I-20ID if the error(s) on your document was made by USCIS, through no fault of your own.

Please consult the "Paying Fees" section of your local office or Service Center page to learn which forms of payment are accepted. Acceptable forms of payment may vary by office. Checks must be made payable to Department of Homeland Security or U.S. Citizenship & Immigration Services."
