Hi,

my fiance and I are a tad confused. He sent me his I-134 form all filled out, but as I was organizing pur papers today, I realized that the checklist sent from the Montreal consulate said it had to be notarized, but the instructions for the form said it did not have to be and same with the USCIS website.

I know the Montreal consulate uses old forms to eliminate paper waste, but I am confused. We did not have it notarized, checklist said it suppose to be, but form says no......arrghhh

Can anyone who has had their interview in Montreal relay to me if they did or did not notarize their Affidavit of Support I-134.

Thanks

If you have the old form, you will notice a section clearly indicating notary signature. If there is no notary section on the form, then you have the new form and it does not require notatization.

I happened to have the old form from my lawyer, so he notarized it, but people who interviewed the same day as us, had a new form unotarized. Neither of us had any issues.

Good luck!

I can't speak on behalf of Montreal, but to be safe have one copy notarized and one copy not. Even though the I-134 new form does not need to be notarized many consulates still asked for the form to be notarized. Maybe its misinformation by the interviewing officers, depends who you interview with, who knows. The edition date on the new form was 10/30/2008. There was a review from a VJ member dated March 7, 2009 who appeared in Vancouver for the interview and had to appear for a 2nd interview because they did not have the I-134 notarized as well as the letters of intent. My motto, better to be safe than sorry.

We went the day before PopRocks did for the interview in Montreal, and we had the "new form" where the form is NOT required to be notarized. We had no problems at all. So, if your from says you need a notary, get a notary. If your form says no notary, then no worries! If you go online and download the "new form", you'll get the non-notary version. The form we got with our check list, etc. required the notary. But, I wanted the most recent version of all forms, just to be on the "safe" side. That's why we had the non-notary version.

Good luck!
