Hi Vj

i need advise , my both cases were approved on same day i130 and i29f . i was more intrested in k3 because i thaught they are not giving immigration it will be less chances for ap . can anyone tell me what will happen now and what should i expect .

This is a big reason why I tend to advise not doing K-3, the K-3 was developed at a time when I-130 was taking a very long time to get approved, the K-3 was developed to let spouse enter the USA and WAIT for I-130 approval, since USCIS has been approving them at the same time, this negates the whole reason for the K-3.

Because both visa types are handled by the IMMIGRANT visa unit at consulate, both visas have an equal chance of AP.

I always advise keeping the I-130 movint through NVC and doing I-864 and DS-230 packets with NVC and perhaps delaying the K-3 interview to allow CR-1 (I-130) to catch up.

CR-1 will save you the hassle of adjustment of status and EAD application, CR-1 gets green-card on entry to the USA. CR-1 can WORK, K-3 CANNOT.

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

Adjustment Of Status: $1010 I-485

I-130: $355

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

($825)

I see many posts from K-3 holders stating, "Wow this sucks, I am stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

K-3 was developed at a time when CR-1 was taking much longer that today, NVC and USCIS has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.
