Hello to everyone...hope you or someone can help me....here is my situation:

I hired a lawyer to process all our paperwork in filing for my wife and kids....I stayed with them in the Philippines waiting for them to come home with me....as you may know I was not employed at the time.....so during the whole process we filed a household affidavit of supports from both my parents which was well over the required amount....during the interview the us consul basically ripped me apart and told me i have to work.....we proved all my assets and my intentions along with my parents affidavit of support which was over 50k from the guidelines....the consul told me to go home to the states and work.....so instead of arguing i agreed....

now i spoke to my lawyer and he said that it is completely incorrect what they have done and we followed up with a domicile and also another affidavit of support from my parents and now my aunt who added another 35k....getting a job now in the states is incredibly hard so we tried again and we got rejected again.....they stated that I myself as the petitioner needs to work....i know this is wrong....and im so tired and confused and depressed over what they are doing to me and my family....

please help what should i do.....what can i do....is there anyway around this.....ive spent tons of money already with legal issues and im still in a stand still.....

Im just throwing this out there, but i would contact my congressman and or senator to try and intervene. This sounds completely WRONG. You are not "required" to work, only prove domicile in the US and intent to move back home. However, I have read that some consulates do not accept co sponsors for a K visa. The 134 is not equipped for co sponsors.

Unless you posted in the wrong forum(k3) and you applied for a CR1, they can require YOU to be the sole sponsor.

Did you guys apply for a K visa and use the 134 for AOS?

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

You land in the USA with wife and kids (with an S), the CO knows you need more than a pledge of support from various family members to survive day in and day out.

It sounds like - when you said you filed a "household affidavit of supports" that you plan to live with your parents initially upon arriving in the USA. I'm just guessing, but it seems you don't have a home of your own (not even a rental) for your family in the USA at this point. If this is true, you are completely unprepared to have (and support) a family in the USA especially considering jobs are not easy to get nowadays.

You need to provide more information, because the information you've given so far isn't enough to help you. We are left guessing like I've already done above.

One last thing, if you aren't working at the time of the interview, unless you have a really strong balance sheet, you will not be approved.

Thanks for the replies.....yes it was a K3 Visa and our lawyer did everything....according to our Congresswoman she said they dont handle issues yet just to find out the current situation but they cannot change the way a consul's decision.....i understand its basically to work but it really seems like they are just giving me and my family a hard time.....my lawyer even wants to go to the press and to write our senator....maybe bring charges upon them.....our follow up stated all the laws in front of them and they still re-worded our follow up documents.....i own the house and 2 cars which are fully paid....they didnt even want to see my assets during the interview and during the follow up....the researcher at the us embassy in the philippines accused and assumed many things....for example that my business is listed in north carolina when i just downloaded from the NY state government website and it shows my business is in NY with my name address and everything....the researchers there had every thing wrong and we have full proof beyond that point....i really appreciate the help and the responses....i hope i can get somewhere with this......at this point i think the only thing i can do is work and maybe more affidavit of supports....but it seems like they are still breaking our law....
