Hello all,

I am a little confused, after a husband comes to the united states on a K-3 visa, I have read here and there to file I-485 with a large fee of $1010.

The k-3 visa is already good for 2 years. I have read through form I-485 and have not found anything related to K-3?

So my question is since I-130 is already out there what is this form for? Do I need to file it within 90 day or should I wait for the I-130 to get approved?

You have to file the I130 first. Once you receive the NOKA1 then you can file the I129f which is the K3. I am sourt of new at this but I will tell you what I got from it. The I130 may take a little longer to get the interview but your husband upon him entering into the States he will receive his GC in the mail within 2wks. The K3 is a nonimmigrant visa and you have to go through a similar process as if you filed a finance petition. So you end up forking out all of this money with the K 3. But if you want your husband here sooner then a few weeks to 1month later then and you have extra money to give to the government then file the K3. I will say this that I have seen others K3 be approved on the sameday or after my I130 and get their interview date. Whereas I am still waiting for my case to be completed at the USCIS. But in the end their husbands/wives may get here first or not but they have to submit documents to USCIS right after they get here and pray that it all goes well. As far me, I will have to wait 2yrs after my Husband get's here INSHALLAH, before we have to file anymore paperwork. Hope this help. Remember I am a newby so you visa journey veterans help out.

K3 is a non immigrant visa and he will have to adjust status [using a I-485] to a conditional resident when he gets here. Without doing so he won't be able to get a SS card. He will have multiple entry rights for 2 years tho. Best to file for AOS ASAP.

The I-130 HAS to be approved to adjust status.

Hint! It would have been MUCH cheaper and BETTER to go with the CR-1 [i-130] all the way. Still can!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

You can forgo the I-485 for adjustment of status, but you would have to return to your home country for the CR1 interview in order to get your permanent resident status.

Decide which is cheaper. Apply for AOS in the US for $1010 (and have EAD within 90 days so you can start to look for work and get your SSN) or wait on the I-130/CR1 process and travel back to your Pakistan for another interview there.
