My husband and I are wondering what we will need to do if his K-3 visa is refused. He has had his interviews and we are waiting for them to contact us with an answer, but want to be prepared in case the worst happens. I have tried searching online, but since I don't know the actual "name" of the paper we will need to file for an appeal, I am unable to find anything. I don't know how long we have to wait to re-file, papers needed, costs or anything. How long does the appeal process take. Is it general for all or does it vary by country? Can someone please help us so we can try and be prepared. Thank you.

You would file an appeal. They will provide instructions for you if it happens.

But - don't get worked up about it now, unless you think it will get denied.

FAQ

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Not sure who is the LPR or the USC, but if you have falsified any of your information, yes you have something to worry about, if not, it takes time, like we have all the time in the world. Isn't there a song by that name?
