Timeline

I got an RFE from USCIS and it says:

"You are ineligable for interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2( b )(10)(ii) until 90 days after the missing initial evidence is received."

They're asking for a co-sponsor since my husband's ITR wasn't able to meet the Poverty Guideline since he only started work October of 2005 and 4 years prior that he was a full time college student. We have that fixed already but my question is this, will this RFE affect my application for an EAD? I put "C9" in my EAD application since I came to the US through K3. I'm just confused since it says there I'm ineligable for employment authorization...thanks for the reply...

My Parent's Timeline

2011-03-14: Mailed application to USCIS

2011-03-16: Application was recieved NOA1 to follow in the mail.

2011-03-21: Received text stating application recieved 03/16/2011.

2011-03-28: Received NOA1 for both petition in the mail.

2011-06-20: Received NOA2 for both petition in the mail. (APPROVED!!)

--- NVC ---

2011-07-21: Haven't heard anything from NVC. Called them and was informed that the Approved Petition was received 2011-06-18. What's taking them so long?!?!?!

2011-07-22: Back on track! Called the 24 hr hotline and got the NVC Number (^__^)

2011-07-23: My parents e-mailed NVC and filed DS-3032 electronically.

2011-07-25: I received an e-mail stating that I am the Choice of Agent for my Parents.

2011-07-25: Called NVC and I got their Invoice Identification Number!!!

2011-07-26: Made online payment for AOS Bill.

2011-07-27: Made online payment for IV Bill.

2011-07-29: AOS payment posted PAID

2011-09-27: Sent AOS, DS-230 & supporting documents to NVC.

2011-10-19: CASE COMPLETE

2011-11-17: Medical Complete

2011-12-08: INTERVIEW!!! - MOM got approved. DAD on AP!!!

2011-12-16: DAD was issued a visa

Hello. I got RFE and my online status showed same thing.

It is interim EAD which you can get at your local office if you did not get EAD by 90days after your NOA1. So we may get interim EAD later than initial expectation... :( But, we may recieve initial EAD earlier than that... So I think OK :yes:

07/11/2006:EAD card arrived

07/14/2006:Recieved interview letter 08/29/2006

08/29/2006:Approved(I-485)

09/12/2006:Recieved Green Card

So, if i don't get my EAD by Aug. 15, I have to go to the Local USCIS to get it? Will we have to pay for it again? Or I'll just go there and inform them that it has been past 90 days for the EAD. So, to clarify, the RFE will not then have any effect or impact on the issuance of an EAD..do correct me if I'm wrong. Thanks again...

It means that you cant get an interm EAD until 90 days after they received the information requested in the RFE.... so you will have to wait longer than you first thought....

You should receive an email telling you that they have received the information and proccessing has resumed on your case.... the date of this email is the date you can use to work out the new 90 days...

Some offices start the 90 days at different times. Get the RFE in quickly and there should not be much delay in getting your regular EAD.
