hi guys, I posted it here in Mexican forum hoping that you can give me an advice for my mexican friend who came here in US illegally and been here for like ten years here in Arizona. Now he has a partner who is also a mexican but a USC now. He's planning to marry her since they have a child already but the guy doesn't know where to start to process her papers. Can he marry her and apply for AOS? I hope anybody here could help me for my friend.

Timeline:

2-02-08: Honey arrived in Manila

2-04-08: travel down to my hometown, Zamboanga

2-07-08: Our Engagement day

2-27-08: 1129F sent to CSC

2-29-08: NOA1

3-02-08: first touch

7-11-08: 2nd touch- APPROVED!!!!

7-14-08: received email from CRIS that our petition has been approved July 11'08

7-16-08: received hardcopy of NOA2 in our mailbox

7-23-08 hard copy from NVC

7-28-08 paid delbros for DV

8-19-08 medical (LORD, pls. keep me physically fit)

8-27-08 Interview, got pink slip, praise God

9-05-08 received my visa, had my CFO the same day

9-06-08 flight to US, POE LAX

11-08-08 wedding day

11-12-08 ssn application under my husband's name

02-26-09 sent AOS packet to Chicago Lockbox thru USPS Express

02-27-09 recieved & signed by V.Bustamante

03-05-09 cashed check

03-09-09 AOS, EAD, AP received

03-12-09 Biometrics appointment notice recieved

03-28-09 sked for boimetrics, 2pm,done

04-13-09 received letter for initial interview sked 05-13-09

04-23-09 AP received

04-27-09 EAD received

05-13-09 passed GC interview, my status online says GC production ordered

05-19-09 Welcome letter received

06-24-09 Green Card receive

02-13-11 Lifting of Condition

02-09-11 ROC package sent

If he came here without inspection there is no way to adjust as there is no entry to adjust from. If he came with inspection then there is a path although it may be less than smooth.

First visit:2007-09-12 to 2008-09-23

I-129F Sent : 2007-11-24

I-129F NOA1 : 2007-11-30

I-129F NOA2 : 2008-03-31

NVC Received : 2008-04-21

NVC Left : 2008-04-23

Consulate Received : 2008-04-28

Packet 3 Received : 2008-05-20

Interivew date : 2008-08-07 CO asks inappropraite questions

His father died: 2008-08-18

Retain Marc Ellis 2008-09

Visited Nigeria again: 2008-11-12

petitioned returned to CSC :2008-11-27

Exactly, if he overstayed his visa but entered legally through a port of entry, either by land, sea or air, he has a good chance to adjust status since visa overstay and even working w/o papers is normally forgiven BUT is he sneaked into the US illegally w/o proper screening, he is prone to get denied and be deported; he should apply to get a fiance's visa IN Mexico and then enter the US legally and get married.

If he came here illegally and they still want to file then the best thing in my humble opinion is to get married first and then file an I-130 as a married couple. It does not guarrantee him a visa but it's a better chance than a K1.

Also, I think it's best to consult with an Immigration Attorney to see what he/she recommends. They don't have to hire anybody but I'm sure they can give them a few pointers especially since they he will most likely get a 10 year ban.

Thank you guys for replying here. I really don't know how she got here in US, either by land ,air or sea. That I need to find out from her. But her partner now is too willing to marry her but they just can't figure out how to marry her when she's an illegal alien here. Anyway, the USC guy is a co-worker of my hubby and we are in the same church here in Az.
