Hi All,

So, life doesnt run as smoothly as expected, and Im in a bit of a quandry right now. I'd like some advice if poss.

I got married a few weeks back, but for personal reasons, our relationship MAY have run its course. If we were to split (but not necessarily divorce) and I returned to the UK, (I've not yet filed for AOS). It sounds bizarre, but what would be the procedure IF we were to get back together and for me to return? Im asking this, cos it may well arise, Im unsure...

Would it be the I-130F we'd file, as we are now married, for me to return?

The chances are, if I do return to the UK, it would be permanent, but I'm looking at all options/avenues/possibilities, as I do love my wife a great deal, but whatever happens - I may not have a choice in the matter and HAVE to return to the UK.

I really am having a bit of a tough time in the US relationship wise - Im not prepared to say anymore than that, but Im sticking it out and giving it my best shot, as much as I can...

Constructive advice appreciated please!

AFAIK if you abandon AOS, she stays in US and you return to UK, and then wish to return you'd have start over with K3 or I-130 (IR1)

Met online 2001 - just aquaintances

Sept 2002 - 1st US visit - everything goes perfectly.

Dec 20th - Forms recev'd at CSC

Dec 27th - NOA1 received by snail mail!

Dec 29th - 'Touched'

March 10 2006 - NOA2!

March 23 - recv'd at NVC

March 24 - petition sent to London

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

May 24th - Medical

May24th - Pkt 4

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received

richi, I'm sorry to read this.

I remember when wogboy went home to Oz after his marriage, one of his concerns was that as he had not filed his AOS, he would have an overstay and possibly be subject to a ban - at the very least not be able to use the VWP.

Maybe some one else will come along and clue us in about this. I can't advise you as I'm not sure.

I agree that Richi would need to return via the K3 I 130 route. Technically he is not abandoning AOS since he never filed.

I am also very sorry to hear that you are having such problem with your marriage. Good luck!!

09 October 4th application package sent. This time they said the app signature page was a copy

10 Oct Sent package again 4th time.

25 Oct Received another NOA for Wife with $625 for the amount with one year extension

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.

Nothing bad sinc eu have nevber filed for the AOS.....but, as they told u b4, once u go back to England and then u decide to come back to america u'll have to start everything over, with a K3 Visa or a CR1/IR1
