Hey can anyone tell me if there is an extension i can file for the adjustment of status.

My wife and i have already married her k-1 expires june 8th also her daughters k-2 expires june 8th.

The issue is simply money....can our daughter be done at a later date????

or is it possible to file for an extension for both i just need a little more time to come up with the moneyany advice would be helpful thanks

You don't need to file for AOS before the I-94s from a K-1 and a K-2 visa expire. There is no 'deadline date'. It is important, however, that you understand that once the I-94s expire the person accumulates 'out of status' days. The AOS is expensive but it is important to make that a priority so you don't collect a lot of out of status days. While it is unlikely to happen, it is still possible for your wife and step daughter to be questioned and detained by immigration as long as they are out of status. Once the AOSs are filed, they have status again as AOS applicants.

So, there is no extension to the I-94 possible but the criteria for the K-1 I-94 was to get married within 90 days, not necessarily to file for AOS as well. Good luck in getting the money together soon.

You file aos after you marry.

Send it in when you get money .

Just get married within the 90 days.......

but i thought if had to be done before her k-1 expires

??

Nah.

What if you got married say like the 80th day, then you would have to wait about 3 weeks for a marriage certificate and then get all your paperwork together.

Just get your aos in when you can, don't wait forever. Of course the sooner the better.............

Mail it in when you do AOS.

Also apply for EAD and AP for your fiance, it doesn't cost any extra when you file.......
