My husband stop working since 2002 till present.

And he never apply for tax then and as I remember he told me

he is exempted to file a tax and i was confused why.

He got 3 pensions from veterans air force,social security and blind pension.

My questions are:What are the basis to be exempted filing tax?

If it is true ,then is it still necessary for us to get an IRS transcript?

Can we attached the documents sent to us from the 3 pensions he had,can't we?

Any answers are appreciated.

I can't answer that, since you have not provided enough information, plus I am not a tax expert.

Well, if he didn't file any taxes, you can't ask for a transcript.

You would have to show the income some how. Also, you would have to provide a written statement on why he didn't need to, and evidence why, as per the instructions for the I-864:

If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

A person can be exempted if they do not make enough income, but this threshold is very low and with military, SS and disability pensions it is certian his income is not low enough to skip filing. While it is very possibly true he may not OWE any tax, he is not exempt from filing. It is two very different things. Military and SS pensions are not tax exempt. I am not sure about the blind disability.

He can file past years tax returns by downloading forms off the internet. Put in 2006/1040 for example in your search engine. There is no penalty for filing late if no tax is owed. He will not be able to provide a statement he is exempt from filing taxes...he is not.

You cannot get a tax transcript if he did not file taxes. Yes, you can attach the documents for his pensions to support his source of income. Filing for AOS requires that the past hree years tax returns have been filed and requires you file any late returns before sending the I-485.
