Birth Certificate needed for Petitioner for NVC Processing?

Hi all,

I am confused whether the petitioner will have to send in their original birth certificate for NVC processing (DS-230 and I-864). I have heard people here said that it's not necessary for petitioner to mail in their original birth certificate.

On the State Dept website (http://travel.state.gov/visa/immigrants/info/info_3195.html) it says:

"The applicant and each family member who will accompany the applicant to the United States will need to submit original documents or certified copies of the documents listed in this section from an appropriate authority (the issuing entity)."

Please advice.

Petitioner does NOT send a birthcertificate with the DS-230 or I-864

Dated since 2004, 10/22/2008 Married in NY, wife left the country, returns on 01/06/2009 as a visitor (granted stay until July 2009)

01/15/2009 Sent I-130 package for CR1 to Chicago Lock Box, 01/19/2009 USCIS Chicago received the application

01/26/2009 USCIS sent out NOA1, 01/28/2009 Moneygrams Order cashed

02/24/2009 Case is in Vermont Processing Center (told by the USCIS by calling the free phone line)

03/02/2009 NOA2 mailed, application approved!!!! (47 days since we mailed I-130 package)

03/05/2009 NVC Received Case / Case number assigned

03/12/2009 DS-3032 / AOS fee bill generated and e-mailed to us, 03/12/2009 I e-mailed and snail mailed DS-3032 and paid AOS fee bill online

03/18/2009 NVC received DS-3032 and it was entered into the system (I never received email confirmation)

03/20/2009 IV Bill generated and I paid online

03/30/2009 Sent I-864 package to NVC, 03/31/2009 Sent DS-230 package to NVC

04/01/2009 IV fee shows unpaid, 04/03/2009 documents are under review (confirmed by operator)

04/06/2009 IV Fee finally shows PAID, 04/07/2009 AVR system says that IV bill has been processed, "instruction package" received by email

04/08/2009 AVR system says "NVC received your documents on April 3...", our case is under review...

04/10/2009 RFE issued for DS-230 Part I, but AOS accepted

04/14/2009 found out the exact issue with DS-230 and sent the response using Chris Parker's RFE shortcut and later in the day received an email checklist for RFE

04/15/2009 RFE response arrived to the NVC facility, 04/20/2009 RFE response received by NVC

04/23/2009 CASE COMPLETED, 06/02/2009 VISA RECEIVED

Depends on what kinda petition are you filing for.

If it's one of these 2 petition, then you need to submit birth certificate:

Petitioner Documents

Applicants in the following visa categories are required to provide 1) an original or certified copy of their Petitioner’s birth certificate and 2) original or certified copy of their Petitioner’s marriage certificate from the Petitioner’s current and all previous marriages.

* Parent of a U.S. Citizen who is at least 21 years old (IR-5)

* Brothers and sisters of United States citizens (F4)

NVC:

1-7-09 NVC Received file, NVC Case# created

1-14-09 NVC Sent DS-3032/AOS Fee bill

1-15-09 Emailed DS-3032 to NVC

1-20-09 Received in mail DS-3032 / I-864 Bill from NVC

1-20-09 Paid I-864 Bill (Online)

1-21-09 Shows AOS Fee Bill Paid online

1-23-09 Return Completed I-864

1-23-09 NVC AVR message says IV Bill generated

1-23-09 Paid IV Bill online

2-9-09 DS-230 package sent to NVC

2-11-09 DS-230 received at NVC

2-17-09 Case Completed at NVC

2-25-09 NVC Left

4-29-09 Interview Date (Called AVR on 2/26/2009 and it said all documents sent to the consulate in KTM, Nepal. Also, talked to the operator on the same day and she said the interview has been set for 4/29/2009 and should be receiving the interview letter soon).

Consulate:

x-xx-09 Consulate Received

4-29-09 Interview Date (Interview rescheduled for earlier date of 4-20-2009)

4-20-09 Interview Successful (asked to come back for the visa on 4-23-2009)

4-23-09 Visa Received

5-22-09 US Entry : Entry at IAD.
