We just received the bill to pay the $70 for proof of Affidavit of Support. I have a few questions though. I plan to use three years of tax transcripts. The first year I made $60,000, the second year $40,000, and the third year I was put out of work on disability for surgery and since disability funds aren't taxed I only made $12,400 on my taxes. Should I include a letter and proof I was on disability.

To complicate things further I was laid off last month. The I-864 has a section to mark that I am unemployed and as of when. It then ask what my current annual income in. I put in what it is based off of my unemployment benefits. This amount is still $6,000 over the poverty limit. Am I going to have issues?

I could try to find a co-sponsor but I am not sure how long that would take me. I feel that my tax transcripts show that I have previously made well above the poverty line and that I am looking for a job. I don't know if it will be counted against me because I'm on unemployment. I want to get this paperwork sent off asap, obviously, but I want to make sure we go about it the right way.

As far as I know, what you made in the previous years does not show that you can CURRENTLY support your spouse. Your most recent tax transcripts will carry more weight since it will be what you use to support your spouse now. As long as you currently make over the poverty limit then I think you should be fine

I just had my K3 visa interview on 20th April, and our attorneys sent to me here in the UK, the form I-864 as that is what we need for the Green Card case once I adjust status. I took that with me to my interview, and the CO told me that they need form I-134 instead and handed me a blue form with a tick in the box. :wacko: My husband, who is a U.S Citizen and at home in the States, contacted our attorneys who sent a I-134 to me via Fed Ex express the same day, it arrived yesterday. I called the Secure Mail Services to come and collect both it and my passport and they came this morning. I am concerned however because I did notice that the figure on the I-134 was not the same as on the 2008 tax return, just filed, but the same as on the 2007 one, and I-864 which our attorneys copied from. At my interview I gave the CO a copy of the 2008 return, but she didn't ask for copies of the 2006, 2007 returns, I did however submit them with the I-134 and my passport to the courier this morning. Our attorneys have told me that the tax return of 2008 shows that my husband makes over the poverty limit... I am just praying that they realize that the figure on the form relates to 2007, since it was prepared before, given that they can see the last 3 years tax returns....and that this doesn't hold up my visa any more. :crying:
