hello guys!!!just have few questions here, hope u dont mind me disturbing again hehe:) im just confused about the social security benefits thing, i want to know what it is really mean,my fiance under social security disability due to a severe back injury and he received payment from the SSA, it deposited directly to his account monthly.is this benefits taxable? say $18,000 for 2008? if not why?its not on his ITR for 2008... im worried if the embassy will going to count this as income, because if not were far from the 125% poverty guidelines:( one more thing is i have his copy of form SSA-1099-ss benefit statement for 2009,is this enough to present together with his rental income? if u could share us your insight about this its really a great help to us. thank you in advance:) best regards and godbless.

thanks for the blessing, i hope i can help.

if you have the origional 1099 form it, there should be instructions on the back that tell you if your fiance's income is taxable. i think it will say to add together the amount on all 1099 forms

and divide by 2 then add his rental income for the year to that. if the total amount exceeds

$25,000 then he may have to file taxes for that. And I think he is able to use both incomes for support purposes

thanks for the blessing, i hope i can help.

hello mari joe:) thank you for your reply, your so nice,i only have faxed copy of his 1099 form, he got $18,000 for year 2008 and $16,000 on his rental, based on his ITR 2008 he paid taxes only for the rental and did not pay tax for his ss benefits.u mean we have to divide 18,000 into 2 plus 16,000 rental?

hello mari joe:) thank you for your reply, your so nice,i only have faxed copy of his 1099 form, he got $18,000 for year 2008 and $16,000 on his rental, based on his ITR 2008 he paid taxes only for the rental and did not pay tax for his ss benefits.u mean we have to divide 18,000 into 2 plus 16,000 rental?

Some forms of income are not taxable and are not included (correctly) on an ITR. Insurance benefits for a loss, workman's compensation (also insurance benefits), child support, are examples. ALL can be counted as "income" by the consulate if you have the correct documentation and proof of payment (bank deposits or check stubs, court orders, award letters from SSDI, etc. Just make sure to document all his income as you would for any other form of income. Sounds like you have everything you need

Yes. The I-134 should state his total income from all sources, then write "see attached" for the explanation of the sources. List $XXX from rental income and $XXX from SSDI. Attach the income tax return and the SSDI documentation. If all the income claimed is supported by documentation it should be accepted.
