Married but filed a K1 visa

Hello to Everyone, this post is regarding to my Friend situation, She was married to USC (her petitioner) but the petitioner filed for a fiance (K1) visa which is suppose to be a CR-1 or K3, And now that they have Manila Case number and near to get an Interview date, what will happen to there case once the Embassy found out that She was married to petitioner but they use a K1 Visa,..Well make a story short It was there Lawyer idea that they can file for a fiance visa to come quick to America all she have to do is present all the documents that she is single , from passport and etc.. but what About the CENOMAR it will appear at the Certificate that you married right... I don't know how will I answer all her question. just need your opinion guys I know no one of us can tell what will be happen to there case but just some info will be Appreciated.. Yes its real even my self can't believe that they filed for K1, and when I spoke to his husband he really don't understand my point and I feel like he's saying I am scaring her wife, I am just trying to help, I think this couple had no Idea about the visa processing, and I am really fell sorry for them I wish I can do something for them. I don't think I can advice them to cancel there petition, they are both excited about the Approval,..

If the marriage is valid and was registered in the Philippines Marriage Registry, she could definitely be denied. I think they should definitely cancel her K1 application.

I wish it just easy to say that Cancel there K1 Application and filed for K3 or CR-1 and to make clear about the lawyer what I understand is they ask the lawyer if they can file a K1 rather than K3 for a quick processing and the lawyer said yes, and now they can't contact the lawyer that's why they ask me what is next thing to do after they receive there Manila case number, and I said to her that she wait a letter from Embassy so she can call for an Interview, and that's where I saw on the paper she's holding that She was under fiance visa and it surprise me, I like to advice to visit this website but i didnt get a chance because he was very angry.. so I just leave but for sure my friend will be here tomorrow,.. and I can show to her what the advice given to them.

Last I saw K1s are required to get a CENOMAR. If they were dumb enuf to submit one they /she'd be toasted.

Plus if they did get by the embassy they'd get nailed trying to adjust status later. I guess they could marry again in the US BUT!!!

The whole trip is a NO WIN situation. Would lose BIGTIME>

that is my point you can show all the documents that you are single but not the CENOMAR, it will appear,. I just advice to her to go to NSO to get a CENOMAR early so she can make sure if there marriage is already in date base if its, then for sure its a big problem,. I also advice to her that don't ever try to falsify her CENOMAR or any documents or else she will be banned forever, I just hope she listen to me

Even if she gets her own NSO, US embassy does their own background check and they always coordinate with NSO employees.

Are you sure its K1 and not K3? K3 uses the same form as K1.

i heard of another case before, they married in the phils but didnt register their marriage. so when they filed the k1 visa, their marriage didnt show up on the cenomar. however, in your friend's case, if their marriage has been registered in the phils, then she might be in trouble if the consul asks for her cenomar. that is falsification of documents and she could be denied. i hope she does the process the right way while its not too late.

I heard this also, they got married here but they didnt register it to NSO.....ANd she went to US thru K1

I would agree with what the other people said here.. just cancel the K-1 and start all over again for the K-3. Better wait a few more months than to wait 10 years, or never.... :unsure:

As of Oct 2008 the USEM got rid of what they call document verification, their way of verifying the CENOMAR. Still I will never risk it.

I advice my friend to get a CENOMAR on Monday so she can sure if there marriage is registered in NSO, BUt I know it took 2 weeks to receive your CENOMAR She is really nervous now, And his husband is not cooperating, He think the Interview is just easy, he said to my friend is just bring her passport and herself and then that it's,. He really have no Idea, I said to my friend that you need lot of documents to prove your relationship,like pic, proof of relationship,, etc... but His husband is not listening, He believes to his lawyer.. I like to show to her this post that I made for her so she believe to all my advice to her...Thank again fellow Vj's

The USEM will ask for her to submit CENOMAR too from NSO so they will have a problem with it too.

@@@@ You need to cancel the visa and go the proper route, if you found lying about the case, it will be 10 years before she can even file to get to the USA. They just knowingly lied in their case. Goodluck and seek attorney soon!

Good Day, its me again.

My 129F already at the USEM they will send the packet 3 to me anytime soon.

I want to pursue CR1, however til now NVC did not give us a case number for my approved I-130. What should I do with the K3? Should i delay sending the packet 3 back to the embassy while waiting for my case at NVC be active? I need your inputs on this..........pls help.

probably not thick headed, just thinks all lawyers are right.

anyway, they can sue the lawyer if they get denied and banned for 10 years. tsk! the lawyer may be disbarred for this... because... i think this falls under perjury... or something of the like. but the damage may be too much already.

who knows, maybe the marriage is not registered in NSO, since there are lots of hoax 'priest' fixers running about town causing trouble. cross your fingers!

if the lawyer is still around, the husband may never listen to you... or his wife. sorry to say, but lawyers words carry greater weight than us ordinary people. they're supposed to be wiser than us... sad to say, they too can make monumental mistakes.
