Multiple Petitions Proof of support Help!!!

Hi Everyone,

My sister just had an interview yesterday 4/16/2009 in manila embassy. she was petitioned by her husband thru K3 visa. Now my brother-in-law didnt able to reach the poverty guideline family of 3 which is $23,000 and my sister was advised by the people in the embassy that she has to get a co-sponsor in order to give her a visa. anyway, the interview went well and visa is pending for submission of co-sponsor papers.

Now, I am in the process of adjusting my status, because I just reached my two years conditional residence last April 10, 2009. Also, my husband is currently petitioning my 10 year old son from Manila. The question is, Can I co-sponsor my sister without any effect on the ongoing petition for our son, by the way, it's my husband's name declared as Petitioner? My husband and I filed Tax jointly.

Please help us, I want to help my sister. My husband and I Annual tax together this year is $65,000. Will it be possible?

Everytning is possible if you meet the Poverty guidelines. Do the math very careful. In my opinion but please check with NVC to be sure if you become a co sponsor for your sister than when sponsoring your child I would use both of yours income $65 000 and in this case you will have to list that you are co sponsor also for you sister so in this case in the worst case the poverty gudeline class will be for 4 people. You, your husband, child and the person you are co sponsoring. The gideline class for 4 people is I believe $ 25 000. In this case you guys are just fine. It`s completely possible even not use your income even when petitioning your child. Just make sure you meet the number they are looking for and + just to be safe. This is just my opinion. Good luck

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

No. My wife about 11USd per Hr. quick computation is $22,880 which I believe falls just short.

Ok - you won't be able to sponsor them by yourself.

However, if the husband makes more than $36,912. then he would be able to sponsor your family plus the sister's. (following the reqs for the I-864)

(after counting household numbers)

Read the instructions for the I-864 and see if they will apply to you.
