If there isn't already a thread for those of us who are hanging in limbo after the AOS interview, I thought I would start one.

At our interview, we were told a decision could not be made until the background checks were completed. Anyone with a recent similar experience care to share? Let's play the waiting game together.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Did they tell you if by background check they meant FBI namecheck?

My husband's application is still pending after our interview on March 11. The officer said he had 60 days to make a decision, so you bet your a$$ we'll be making an infopass appointment for May 11 if we haven't heard by then! Good luck with everything!

5-13-09: Green card approved.

6-24-09: Received green card.

8-13-11: Received 10-year green card.

2-21-12: Sent N-400 to Dallas Lock box.

7-18-12: Naturalization interview (passed!).

rrobin, the background check means the same as security check, from what I have read. So I assume the FBI check is included.

KPC, we were not told even that. At least you know you have a timeframe to go by. We would be making the infopass if need be, but it is too early at this stage of the game, besides my husband will be back in Egypt next weekend and will stay a few months, depending on what's going on with our petition.

Best wishes to you for a quick resolve!

We have our AOS interview on Monday. I'm just upset that they may take his EAD card and AP card, and the I-94 leaving him with nothing to prove his legal residency in our state which is REQUIRED for getting his driver's license. He has his test on 4/21 and if he has no document to prove he is here legally he won't be able to get it... and after reading the posts here something tells me he won't have his green card by then either! Fortunately he has a job already (and hopefully they won't ask to see his EAD again...)

Did they take your husband's EAD at the interview?

No because they said they could not give us a decision . The IO looked at both of his docs, but handed them back. You could ask for a stamp in his passport, but I heard they don't do that anymore. Perhaps if you explained you will need it???? Does he have his SS # yet? Name on utility bills? Can you make a copy of his I-94, EAD, and AP to bring to the DMV?

Best wishes for Monday!

If they try to take the documents, just ask if he can keep them because of his upcoming appointment with the DMV.

Not all DHS employees are trolls, you know.

The problem is that the EAD and AP documents are invalid once the AOS has been approved, even if you don't yet have the green card, so if the Department of Motor Vehicles checks them in some way (if they can), they won't pass.

Actually the problem is if they take the cards away and then don't approve the AOS, or if the green card (giving us tangible proof of their approval) isn't immediately sent to us. Taking away our only proof that he is here legally, without giving us something for the interim period is my issue. And if the DMV was able to "check" on his status they would discover he has been approved for the Green card and they wouldn't care if he had an EAD or AP.. But it appears they cannot, or why would they ask us to bring physical proof? So frustrating...
