i am US citizenand applying for my husband who is already in US living with me from 2007 on F-1 visa, but my income is not enough and we have a cospose that is not living with us ,but he is our relative. We filled almost all the columns, expect his US status(he is US citizen). If he fax that document to us,can we attach fax copy of status of US citizen with I-864.

2) His individual annual income is enough (because that fulfilling the guidelines of Poverty)but his tax return is joint with his wife (Her income is not included),because of this joint tax does his wife need to complete I-864A or she doednt need to fill any form.

3)Household Size : in co-sponser family there are 4 family members (he ,his wife and two dependent children).so to fill form I-864 he should consider only these 4 family members or should he consider that person for whom he is co-sponsering.PLEASE REMEMBER THIS CO-SPONSER IS NOT living with us.His family lives seperate and we live seperate.

The only question that i truly know how to answer is the later, Your co sponsor MUST include the immigrant in his household size, to make sure that he does not become a public charge (which is the whole reason why you guys are filling out this paper) So if the co-sponsors household number is 4, (witout your husband,) you need to put 5 to include your husband, somake sure and double check that he makes enough under the poverty guidelines. good luck.

1. Faxed copy of US citizenship document should be fine, make sure it is legible

2. His wife does not need to fill anything out. His documents need to be the same as yours as far as support documents

3. Family size is his family PLUS the intending immigrant(s) he is co-sponsoring
