Hello,

I'm hoping this is a quick question for you guys with more experience. If you submit the AOS, AP, and EAD at the same time right after marriage, and get an RFE for something in the AOS (say the vaccination supplement form), does that effect the AP or EAD in any way? Or do they send them to different dept's after receiving them and process them separately?

Thank you!

Melissa

Anyone else with experience?

Hi! Guys! Actually, I already posted my experience for a few times but I would like to share my experience again. Hope all of you don't get bored before I finish.

Before I got my EAD and my interview notice from MSC, my husband and I received RFE for I-485(proof of supporter's income), we got it around Jan 06 and they received our response on Jan 31, 06. Since then we'd never heard anything from them until June 17, 06. See what we did: did three info pass, called customer service(we got a referral number), wrote a letter to our congressman and read this website's thread everyday. In my opinion, if you haven't gotten your EAD within 90 days after your biometrics, I would suggest you do the same thing as I did. Actually, my husband and I just wanted to follow up about the EAD in the first place, but we got both EAD and our interview mail on the same day. Wow, it's more than what we expected before. My idea is: if you have the same problem like us, just try to get EAD approval first, once they look up your file, they might as well send you the interview notice. Hope, my experiece is useful. Good Luck!!!!

Having followed others' experience and having been through it ourselves, I think the answer to the OPs question is that the RFE can hold up your EAD but won't necessarily. Some people have gotten back on track right away, but others like us have had the EAD sort of go to no-man's land after the RFE. But I don't think anyone can say with any certainty if the RFE was definitely the cause of the delay.

My husband still hasn't received the EAD card (although it's been approved)...day 134. Good thing he was able to get the interim through infopass at day 90.

Hi there.

Our two AOS RFEs did affect the EAD processing. Each RFE put the AOS onhold until the RFEs had been processed. More info in the sig.

Hope this helps.

Regards,

Martin
