hello guys i've been a member of this site for few months now but i never post, i just read. I am a december filer and last Feb 14, 2009 i received RFE requesting evidence of Form I-864. My husband is self employed, it says that the income is below poverty line. His gross income is way above poverty line but the net was below because of the expenses. He doesn't have that W2 or 1099. What he did was he wrote a letter commenting on his income tax that the depreciation is counted as his profit so it exceeds the poverty line. We sent the letter and bank statements from August til February with 25,000 on it, last February 26.

My questions are:

1. Are those documents enough to support the I-864?

2. It's been 5 weeks but we never get any reply that my case is resume. what should we do?

YOur help is highly appreciated. thanks

Being self employed without 1099s he should have sent in tax transcripts from IRS. Also it wouldn't have hurt to take a few less writeoffs. He could have always amended the return later.

we sent the form 1040 and schedule C. Do you mean the whole tax transcript IRS?

Tax transcripts you get from IRS are 2 pages.

900 829 1040. Free and 24/7. takes about 6 days to get them. They ARE more valid than 1040 returns.

You can have them faxed to you in one day during normal business hours.

Have the US citizen get 3 past years.
