Hey guys,

I'm a december vermont filer and like a lot of my fellow VJers right now getting pretty excited about my NOA2 which shold be coming any day.

I have a quick and likely simple question - is Advanced Parole "COMPULSARY" for a K-1 filer adjusting status?

I understand that AP is used so that the beneficiary can travel outside the US before Adjustment of Status has been approved, hence getting around the abandonement, but I don't have plans to travel outside the US certainly within the first year or two of immigration.

No, it's not.

It's only suppose to be used for emergencies anyway, but people get it in "case" there is one back home.

It's free while you file with it with the AOS/NOA.

If you have a true emergency, you can always get an INFOPASS and they can expedite the AP.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

AP not required but definitely a plus incase a NOT planned emergency pops up back home. Free when you apply for AOS. Sometimes AOS can take a LONG time. Doing a Infopass may work but that takes some time also. If you have a AP in hand you can fly immediately.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

It's free to apply for AP when you file AOS so makes sense to apply to be on the safe side in case of emergencies back in the UK.

12/09/2008 NOA2 approved

01/13/2009 Medical completed

02/03/2009 Interview - APPROVED!!

02/28/2009 POE Raleigh/Durham

05/02/2009 Official wedding day...get to see the family!

04/11/2009 AOS paperwork sent

04/17/2009 NOA for I-765 & I-131

05/13/2009 Biometrics appointment

05/08/2009 Biometrics done

06/05/2009 EAD & AP approved

06/23/2009 back in the UK
