I-864 question

so after paying the AOS fee and following the links to continue the filing of I-864, i read carefully all the different options for me regarding I-864.

i read them all and they are quite clear as to which ones are applicable to myself (petitioner)

however, in reading the I-864W (aos exemption) it seems that the information they ask, and the qualifications required are pertaining to the immigrant or benificiary.

whereas the others ask for and pertain to the petitioner.

is that in fact the case?

I-864W has to do with beneficiary, typically if the beneficiary has lived in the USA before like as a H-1B worker, and had worked and was credited with 40 quarters of work, they would be exempt from needing an affidavit of support and wont need a sponsor.

Another use of the I-864W is for an immigrating child who would become a US citizen the moment they arrive in the USA, for example an adopted child, or parent had immigrated several years before and became a citizen, and the child under 18 arrives later on an immigrant visa.

my husband was here for 3 years on an h2b works visa, so he has a social and everything, we still filled out the appropriate affidavit o support and i had a sponsor, is that ok? I think it is.. but just double checking... If anything itwill only help the situation that he has been here before. I know it did when i showed his tax information and stuff showing that he can support himself and that he works hard.

That is correct, you do an I-864.. Prospective immigrant would have had to been working and credited with 40 quarters (10 YEARS) of work. To use the I-864W
