As some of you read on my previous post, my K-1 Visa NOA2 letter came in the mail the day i was getting married heheh. So, my quandry now, is that since it has been passed to Manila already, how do I go about canceling/withdrawing my K-1 petition so i can file my new K-3?

Can I just file the K-3 now, as it is ready to ship, or can I include a letter in it requesting a withdrawal?

Thanks, any help is appreciated, I want to get this ball rolling ASAP, me and my wife miss each other terribly.

For one go with the CR-1 instead of a K3. MUCH MUCH better visa. Cheaper and less hassel also.

For one go with the CR-1 instead of a K3. MUCH MUCH better visa. Cheaper and less hassel also.

You are the second person that I have heard say that. I think that will be my plan then. Is the filing the CR-1 pretty much the same as the K-3, except you don't send in the I-129?

Right, except you don't send the I-129F. I-129 is a petition for a worker. There are other differences later in the process but at the petition filing stage, it's that simple. Frankly, I don't see why a withdrawal letter placed on top of the filing wouldn't work. It would seem the combination of the withdrawal letter and the I-130 in the same package would add clarity and potentially save time but I must say I've not seen it done that way. I'd enclose a copy of the approval notice as well.

Facts are cheap...knowing how to use them is precious...
