Hi everyone! I am new to this site. For days, I have been reading a lot of posts and I find it very helpful and informative. Anyway, I am a RN in my country and I have a pending employment-based application or E3 visa. But due to the retrogression, my priority date (PD) is way too far yet from the PD's that NVC is processing. Not to mention, it is the second E3 petition already, because the first one, my US employer revoked their job offer due to my agency.

I met my fiance 2 years ago online. He knows about my pending E3. We met once and he will be visiting me again in June. But we are getting so impatient already with the very slow movement of the E3. We both expected that the retro will be lifted last October 2008 but what happened, it slowed down even more! I think it will take another year or two for me to have my E3 approved. Now, my boyfriend is asking me if I would agree for him to file a K1 visa.

I said YES. But I have a few questions on my mind for K1. I hope you could give your opinion or share your experiences related to what I will ask below:

1. Will the USCIS see my E3 pending application? I know the records are computer-based. Will it affect my K1 application?

2. Will they ask me about my E3 application? And considering that in the biographical information I will complete, my employment history will reflect that I am a nurse.

3. What is your advice? What is the very important evidence that we should pass? I fear that the consul will think that we are applying for immigration purpose only. But I just want to be with my bf and I don't care what I will do, as long as we will be together!

4. Is there a chance for us to have a K1 visa approved?

No effect...

E3 is if I am not mistaken, a dual intent visa.... but if you have actually applied for the E-3 the consulate may ask for you to withdraw it when you get to that stage
