Hi,

My husband is American and I'm a Canadian. My Green Card meeting is in April and if all goes well then I will be immigrating to the USA as soon as possible (hopefully May!)

My question is, if we have been married for over 2 years, do I get a 10 year visa or a 2 year Conditional Visa?

I heard that we would get a 10 year visa because we've been married just over 2 years.

Also, If I have get a 10 year visa and leave the country for longer than a year, do I still have to apply for a Permit of Re-entry (I-131)?

My husband and I are hoping to get temporary jobs in Japan (contract for about 1 or 2 years), but we have every intention of returning and residing in the US.

Hope someone can help us on these...it seems like just as i'm getting my bearings in one area, something else pops up and I find myself being educated about something I was never even aware of.

Cheers!

Martine

1) YES YOU ARE GONNA GET 10 YEAR PERMANENT RESIDENCY. (MARRIAGE IS MORE THAN 2 YEARS)

2) IF YOU STAY ABROAD MORE THAN 1 YEAR, YOU SHOULD APPLY I-131 BY PAYING $305 BUT THIS TIME FRAME DOES NOT COUNT

TOWARDS CITIZENSHIP APPLICATION. TO PREVENT THIS, YOU HAVE TO FILE N-470 BY PAYING $305.

SO ALTOGETHER, THIS TEACHING JOB IN JAPAN WILL COST YOU $610.

USCIS IS LIKE A FORTUNE 500 COMPANY MAKING MONEY ON POOR IMMIGRANTS LIKE US :crying:

NO WONDER USCIS CALLS US "CUSTOMER"

Thanks Cino,

I don't think I would even bother with the N-470 as I could probably make up my citizenship requirement time in the last 5 years of my Green Card (if it's a 10 year Green Card). I try not to give them too much of my money.
