Hi vjers...I want to attend a vocational school for one year full-time but I am my husband's sponser. He has a job that is over the poverty level and he wants me to quit and go to the school but Im not sure I can because I am his sponser. can I or not? we are filing for AOS now. Please help me answer this question for us.

03/09/2013: Married

09/10/2013: Sent I-130

09/12/2013: Case Received.

03/04/2014: Petition transferred to Nebraska Service Center.

03/25/2014: I-130 Petition approved

03/28/2014: Petition sent to NVC

04/09/2014: NVC received case

05/08/2014: NVC assigned case number

05/16/2014: Paid AOS fee

10/02/2014: Case Closed

10/10/2014: Interview Date Scheduled

11/17/2014: Interview - APPROVED!!

Please update profile Showing AOS pending or AOS approved, as far as I can tell you are here on a K-3 and ahev not filed to adjust status yet.

If he has green-card you can quit your job without any problem, a sponsor is not obligated to remain employed once the sponsored immigrant has green-card. The sponsor is simply obligated to repay the government for any means tested benifits that the immigrant may apply for (AKA Welfare)

If you are in process of getting the green-card or have not filed AOS yet, then IF the K-3 has an EAD and is working the K-3 holder can fill out an I-864A and ADD their income to your income and self sponsor, You provide I-864 as sponsor, and K-3 holder provides an I-864A as a member of household.

We will be filing for AOS this month. so not yet pending. Thank you for the info. Last time i checked the processing times it was taking 2 years for california so I will be working again by the time they even get to our paperwork. Thank you for the information its good to know.

You may want to do some more reading, AOS does NOT take 2 years, in our case it was 4 months. For the most part those who adjust from a K-Visa in many cases get approved without an interview.

Look at the timelines.

Does your husband have EAD?? If so then yes you can quit your job, You will file I-864, and he will file I-864A when adjusting status.

Yes my husband is working legally here. he filed for his ead when he came and we have waited till closer to 2nd year anniversary date to file for aos. Thank you for the info because we are both planning to go to the same school but I will go first. I wont start til december so maybe our aos will be approved before then :)
