I got the generic- case is under review - from a service request sent in on my wife's application for the i-485/i-765. Our NOA1 date was 11/13/2008.

We have no EAD either...is there a way we can at least get that while our case is being "reviewed" or is something we just have to wait out?

Any comments would be appreciated

Hi,

Just to share my thoughts...

My AOS is also pending - under review. But, I received my EAD after about 2 months from filing, just after my biometrics was done. Just recently, I applied for the extension of my EAD since it has expired and now waiting for the new EAD card to be issued to me.

I would suggest you schedule an INFO PASS to know what happened to your wife's EAD since it has been over 60 days (if I am right) from the date of filing.

It can take up to 90 days to get the EAD. If your at 60, you still have some time before the panic starts

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I would not wait 90 days before I schedule for INFO PASS. USCIS may not very accurate and not consistent anyway. I went through with this already. I waited over 90 days and nothing had happened and it was after my INFO PASS appointment that my husband and I learned that our papers are sitting in one corner and no one (LA, CA USCIS) had informed us that we have a pending case.

Maybe, 60 days waiting is enough and I would go for INFO PASS. They will attend to us and answer our question.

Just a piece of thought.
