hi everyone :)

my case is like this:I've got my K1 in hand now and me and my fiance are going soon to Las Vegas :dance: to get married. This is the way we like and want to have our ceremony and honeymoon.

We will stay only about 8 days in US and I think I will not able to have anything done including advanced parole. We have to come back to Germany -my fiance is stationed here (Air Force).

So we will start K3 visa process.

I know that some people will say that I could get a tourist visa just to get married but I REALLY didn't want to risk that they will not let me in since my intentions differed from visa purpose.

N-400 timeline (under sec. 319 b from overseas)

9/13/2010 - N-400 packet sent to Vermont

9/21/2010 - NOA

3/11/2011-after emailing Faifax Office: biometrics scheduled for 1 Apr, 2011 and interview date 6 Apr 2011

4/6/2011 - interview and oath ceremony

WOW!! I just wanted to ask why didn't you do DCF, but I guess if you wanted to get married in Las Vegas, then this is pretty much the only way to do it. (I thought about the same thing, marrying on WVP, but I thought, the risk is just too high)

There is nothing illegal whatsoever about entering the US on a tourist visa to marry so long as you had returned to Germany after that. I'm not sure why you thought it was.

Too bad that you didn't ask about that before now. Wow. Waiting for a K3 after all the waiting you've done for the K1 (not to mention the money involved!) is just mind boggling.

Anyway I hope it goes quickly for you this time around.

Too bad that you didn't ask about that before now. Wow. Waiting for a K3 after all the waiting you've done for the K1 (not to mention the money involved!) is just mind boggling.

No, of course it is not illegal to get married on a tourist visa, but if the Immigration officer at the airport thinks, you wanna sneak into the country like that and won't accept your binding ties back to Germany, you might be in trouble. Happend so with a friend of mine. She got send back home on the next plane.

Of course you wouldn't tell them you want to marry, but I sometimes had trouble to get through there just saying "I want to visit my bf." :rolleyes:

Good Luck, & try get a copy of your medical or remember to mention it to the Embassy if its less that 1 year when you interview for CR1 or K3 :thumbs: ......as the medical is good for a year :yes:

or try DCF!!!

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

Mailed I-751 April 12th 2008

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Biometrics Detroit May 10th 2008

10 year Green card ordered August 20th 2008

what is DCF?

Sorry...Direct Consular Filing. It is basically filing for a C-1 or C-3(?), when the petitioner and beneficiary are in the b's country...since your fiance is stationed in Germany, you could have filed through the embassy instead of going all the way through USCIS. Pretty fast process. I wished I could have done it like that...

the reason for my concern to get married on tourist visa was that they woudn't let me in at POE because they woudn't trust I was going to leave US after that. And I didn't want to hide my intetions (I am flying with my wedding dress :-) ).

There are also some previous topis from people who were denied entering US on tourist visas under suspect that they were going to get married. They were going only to visit their fiances or fiancees.

I can wait again since we won't be in a hurry. My fiance is going to be stationed in Germany until March 2008 so we have some time..

Sorry...Direct Consular Filing. It is basically filing for a C-1 or C-3(?), when the petitioner and beneficiary are in the b's country...since your fiance is stationed in Germany, you could have filed through the embassy instead of going all the way through USCIS. Pretty fast process. I wished I could have done it like that...

I was trying to post you the link to the DCF guide on here, but it didn't work, but you can easily find it in the DCF section on here...

I was reading into it when out of a sudden a chance for my fiance to get stationed in Germany came up (we already started K-1 and it didn't happen anyway, but I thought it sounded very good) :thumbs:

YES CR1 will be the visa you get, as thats the 1 for people married for less than 2 years :thumbs:

Well, there isn't a choice between CR1/IR1 and K3 - if you apply for a K3 you must first apply for CR1/IR1 in any case. It could be worth checking with the website of the US Consulate in Germany to see what their rules are regarding DCF. They won't call it that (that's not the official title) but they may allow it depending on your legal status in Germany.

yes, I have to talk to them. I wanted to process my K1 here since I 've been living here and with fiance for over a year now and they didn't object...I may be wrong but as far as it comes to Germany and EU people you can reside here if you want for how long you want (the letter I got from the city hall) and that is your legal status. So it is probable that US consulate in Frankfurt will process my next case. I am thinking though to direct it to Warsaw. Home is home :star:

Oh my goodness.

Agnes, you and your boyfriend should really, really get some legal help. You are doing things about the hardest and most expensive way imaginable.

Go forth, get married, have a great time in Vegas and enjoy your lie in Germany together. When you are about 6 months from wanting to immigrate to the US, have your husband file his petition for you *in Germany*. If he doesn't know what that is all about, he should go to his JAG office.

PS: A K-3 is NOT the appropriate visa for you after marriage. It's not illegal, it's just not the best way for you to immigrate, IMO.
