Hello!!!!

I arrived here as a K-1 visa holder.My husband and I were married before my I-194 expired. I am out of status now. We are supposed to apply for the adjustment of status but my husband got laid off. Can you give me an advice on what to do about this? We planned to ask his brother as a co- sponsor. Will I be granted for a green card if we file for the AOS when in fact my husband is a principal sponsor and he has no work right now.

Please give me an advice.

Yes, get a co-sponsor and file as soon as you can. You don't want to be without status very long. USCIS is just concerned that you will not be a financial burden on the taxpayer so even if your husband is currently out of work, if his brother is willing to be a co-sponsor and meets the financial criteria USCIS will be satisfied. Good luck on your husband finding a new job and on getting the AOS.

You will not have a problem adjusting status with an unemployed spouse.

Your spouse will file an I-864, and your joint sponsor will also file an I-864.

Is now a US Citizen immigration completed Jan 12, 2012.
