So this is our case : My husband filed I-130 as a Permanent Residence for me last June 2008, we received NOA for it that they received our documents and the receipt notice..(CA processing center). My husband will soon take his oath to be US citizen this Feb. 26, we will then UPGRADE my papers as soon as he gets his Certificate of Naturalization, my question is: Does this process will then be more faster? and does those times we applied for I-130 last year is counted for it to be approve? how long does it takes? any ideas is very much appreciated, and anybody here has the same situation with us? thanks a lot and more goodluck!

i did same for my wife in india. I filed I-130 as PR and then I upgraded the petition. I think it usually takes 2 months to get approved and once its approved its upto you how fast you submit all the required documents. So, my advise is keep ready all the required documents birth certificate in english for you and your husband, marriage certificate, pcc, afidavit of support papers. pay the AOS and IV fee online that will save some time too. I hope this will help

thanks for your reply and info, so you mean normally after upgrading, USCIS approves I-130 in 2 mnths approximately? in which processing center are you...we are in CA, how's your case? and to your wife? thanks again...

Right after his oath, tell him to call USCIS to upgrade the petition. The upgrade is way faster, because visa number is immediately available to US Citizen immediate relatives.

In my case, the petition was approved by USC less than a month.

Does anyone know if you have to pay extra to upgrade the application?

No additional payment necessary. Just adviced them to upgrade the petition and you wont get charge for it.

hey my husband filed my I-130 as an LPR in march 2007.He became a US citizen in dec 2008 and upgraded my application.We are still waiting for an approval.Guess we are not that lucky to get an approval yet.

He just has to call and upgrade and I guess send a copy of his naturalization certificate when asked.I have a question to all those who have upgraded and been approved in about 2months.....Do we have to call and check often with VSC(thts where my application was filled) our case status?why is it taking so long?also noticed tht now its 6months for I-130 for US citizens spouse.

Please advise. Its been a long wait for my hubby n me and i really thought we would get approved in 2 months:(he has been in teh US since oct 2003 and I am in India.He has visited India every year though in teh last 3yrs.

Awaiting some advise from you guys.

CSC is normally very fast in processing this kind of request, VSC is very very slow. My advice is to call the 1800 and ask for expedite or at least open a service request since your case has been filed long time ago.

my husband filled petition for me while he was LPR now that he is USC he sent the copy of his naturaliation cert. enclose with the letter of upgrade, NOA1. after a week he called USCIS. after 2 days he received letter for USCIS that the petition has been upgraded. we dont know what the next step will do, do we have to call again USCIS and mailed them again letter of upgrading petition??

please help...i know u have more knowledge about this kind of case... ur help will be much more appreciated. GOOD luck :innocent:

Hello Evryone! Im new to the site, but i have the same dilemma. I am a green card holder for 4 yrs now and next year Im going to file my naturalization so I can petition my husband. Will it be faster if I file for him now as a spouse of a permanent resident then just upgrade it or wait till next year july 2011 after i became a citizen? I hope those who have experience with this kind of things will enlighten me. We just got married last Dec2009 and were expecting a baby this year that's why Im pretty much wanting him to come in here as soon as possible.

hi i have a burning question

my i-`30 is approved this month AND my husband will becoming citizen by next month as waiting for oath cerenmony.

does he has to call usics to upgrade or nvc and what is the best procedure

can he send email to nvc with his naturalisation certificate or call usics? please advice
