For Adjustment of Status you need form I485 and for EAD form I765, then for AP I131. All of these forms you can download from the USCIS site. The AP is for you to be able to travel outside US while waiting for your AOS to be approved. Me, i didnt apply for AP since i dont have immediate plan of leaving the country and now my GC is coming already. So it depends on your situation.

There are so many related discussions here that could help you in filing for your AOS and the USCIS site is also very clear as to instructions and documents you have to submit. So, just visit all the possible links that could help you in this process. Also, here n VJ there are so many who are very willing to answer your questions. So feel free to ask and enjoy VJ as much as i enjoy my visa journey.

ADditional info:

Forms needed for AOS:

I485 AOS

G325A Biographic Info

I864 Affidavit of Support

I765 EAD (optional)

I131 AP (optional)

Goodluck!

J.kevs.

I have another question. I was married in 2004 and got divorced in May 2007. My Ex-husband and I reunited in Oct 2008 and now I am pregnant.

He is elegible to become a citizen now. So we are in dilemmo that whether to get married now and apply for N400 (Citizenship) or without wasting time now apply for N400 and then will get married later. We are expecting him to get his citizenship somewhere in June 2009 with 4 months minimum time period.

Please advise.

Thank you.

I am not sure and i really dont know about those things. But, in my opinion i guess it doesnt matter either way. But somehow better if you are really married already again. He should also apply for his citizenship as soon as he can. But honestly i really dont know. Try to look for sites regarding your situation and lets just try to wait for others to give their opinion on this....

So sorry.

If you want to get green card as soon as possible, then probably it will be better to get married now.

Hi,

We are planning to get married on Mar 6th 2009 and he is applying for N400 around 3rd week of Mar 09. So what date will they consider for 2 yrs green card. Is that from the date we received the Conditional green card or from the date of marriage it's 2 yrs?

I am just curious to know how that works. Now I am having valid 3 yrs extension h1b (work visa) until Dec 2011. So I am fine for another 3 years. The Greeen card take anywhere from this 3 yrs.

Thank you Diazy.
